1.3 General notes on data processing
The protection of personal data is an important concern for PÖTTINGER GmbH. Personal data is processed exclusively in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and the relevant Austrian laws (DSG, TKG 2021, etc.).
This privacy policy provides information about the nature, scope and purposes of the processing of personal data, as well as the rights of the data subjects.
Automated decision-making, including profiling in accordance with Art. 22 GDPR, does not take place within the scope of data processing by Pöttinger Landtechnik.
If additional or more specific data protection information is required in the context of individual processing operations (e.g. at trade fairs and events, in the application process or in the case of enquiries about sponsorship or factory tours), this will be provided separately at the point where the data is collected.
 

Data processing in context of the use of this website

2.1 Provision of the website and server log files
Each time the PÖTTINGER GmbH website is accessed, information is automatically collected by the web server and stored in so-called server log files.
The following data in particular is processed:
IP address of the requesting device
Date and time of access
Page or file accessed
Browser type and operating system used
Referrer URL
 
This data is processed for the following purposes:
the technical provision of the website,
ensuring system security,
error analysis, and
to prevent misuse and attacks.
 
The legal basis for this processing is Art. 6(1)(f) GDPR (legitimate interest in the secure and stable operation of the website).
There is no personal evaluation or merging of this data with other data sets.
Storage period: The server log files are only stored for as long as this is necessary for the purposes mentioned and are then deleted.
 
2.2 Cookies
Cookies and similar technologies (see section 2.3) are used on the PÖTTINGER GmbH website.
Technically necessary Cookies are used to ensure the operation, security and basic functionality of the website. These Cookies are used on the basis of Art. 6 (1) lit. f GDPR (legitimate interest) and § 165 (3) TKG 2021.

The use of Google Analytics is based exclusively on your express consent in accordance with Art. 6 (1) lit. a GDPR in conjunction with § 165 (3) TKG 2021.

2.4 Contacting us via the website
When contacting us via the contact options provided on the website, the personal data transmitted by the data subject will be processed exclusively for the purpose of processing the respective enquiry.
The processing is based on:
Art. 6 (1) lit. f GDPR (legitimate interest in the proper processing and response to enquiries).
The data processed in the context of establishing contact will be deleted as soon as the enquiry has been finally processed and there are no legal retention obligations to the contrary.
 

Processing of customer data

In the course of its business activities, PÖTTINGER GmbH processes personal data in particular from:
Customers (in particular dealers and distribution partners),
contact persons at customers and sales partners,
end customers, insofar as they contact PÖTTINGER GmbH in connection with service, information or satisfaction enquiries.

Personal customer data is processed for the following purposes:
Initiation, conclusion and processing of contractual relationships with customers and sales partners,
Communication within the scope of business relationships,
Technical advice, services and processing of enquiries,
Conducting satisfaction surveys,
quality assurance and further development of products and Services,
Fulfilment of legal obligations.
 
3.3 Legal basis for processing
The processing of personal data of customers and contact persons is based on the following legal bases:
Art. 6 (1) (b) GDPR, insofar as processing is necessary for the initiation, execution or termination of a contractual relationship with customers or sales partners,
Art. 6 (1) (c) GDPR, insofar as processing is necessary for compliance with legal obligations,
Art. 6 (1) (f) GDPR, insofar as processing is necessary to safeguard the legitimate interests of PÖTTINGER GmbH, in particular for customer communication ( ), conducting satisfaction surveys, quality assurance and product improvement.
 
3.4 Transfer of data to dealers in the frame of satisfaction surveys
If end customers expressly indicate in a satisfaction survey that they would like to be contacted by the responsible dealer, the necessary contact details will be passed on to the respective dealer.
The transfer takes place exclusively:
at the request of the data subject and
for the purpose of the responsible retailer contacting them.
 
3.5 Data sources (Art. 14 GDPR)
Personal customer data is usually collected directly from the data subject.
If personal data is not collected directly from the data subject, it comes from the following sources in particular:
Sales partners and dealers,
Contact details provided in the context of business relationships,
publicly accessible sources (e.g. company websites).
 
3.6 Recipients or categories of recipients
Personal customer data may be transferred to the following recipients or categories of recipients, where necessary:
internal departments of PÖTTINGER GmbH,
Sales partners and dealers,
IT and system service providers,
Logistics and service partners,
authorities and public bodies, insofar as there is a legal obligation to do so.
 
3.7 Storage period
Personal customer data is stored for as long as is necessary to fulfil the aforementioned purposes. In addition, data is stored in accordance with statutory retention and documentation obligations and for the assertion, exercise or defence of legal claims. Once the purposes no longer apply or the statutory retention periods have expired, the data is deleted.
 

Data processing of supplier data

In the context of its cooperation with suppliers, PÖTTINGER GmbH processes personal data in particular from:
suppliers,
contact persons at suppliers,
other contact persons within the scope of existing or initiated supplier relationships.
 
4.2 Purposes of data processing
Personal supplier data is processed for the following purposes:
Initiation, conclusion and execution of contractual relationships with suppliers,
Supplier management and communication,
Quality, risk and compliance management,
Processing of orders, deliveries and payments,
Fulfilment of legal obligations.
 
4.3 Legal basis for processing
The processing of personal supplier data is based on the following legal bases:
Art. 6(1)(b) GDPR, insofar as processing is necessary for the initiation, execution or termination of a contractual relationship with suppliers,
Art. 6 (1) (c) GDPR, insofar as processing is necessary for compliance with legal obligations,
Art. 6 (1) (f) GDPR, insofar as processing is necessary to safeguard the legitimate interests of PÖTTINGER GmbH, in particular for supplier communication, quality assurance and to ensure legally compliant business processes.
 
4.4 Data sources (Art. 14 GDPR)
Personal supplier data is usually collected directly from the data subject.
If personal data is not collected directly from the data subject, it comes from the following sources in particular:
Information provided by the respective supplier,
contact details transmitted within the frame of existing business relationships,
publicly accessible sources (e.g. company websites, public registers).
 
4.5 Recipients or categories of recipients
Personal supplier data may be transferred to the following recipients or categories of recipients, where necessary:
internal departments of PÖTTINGER GmbH,
IT and system service providers,
Logistics and transport service providers,
tax advisors, auditors,
authorities and public bodies, insofar as there is a legal obligation to do so.
 
4.6 Storage period
Personal supplier data is stored for as long as necessary to fulfil the aforementioned purposes. In addition, data is stored in accordance with the statutory retention periods and documentation obligations (in particular under the Austrian Commercial Code (UGB) and Federal Tax Code (BAO)) for up to 7 or 10 years and beyond, if necessary to assert, exercise or defend legal claims. Once the purposes have ceased to apply or the statutory retention periods have expired, the data will be deleted.
 
4.7 Supplier registration portal
Separate data protection notices apply to the processing of personal data within the scope of the supplier registration portal, which are made available to the data subjects in connection with the use of the Portal.
 

Data processing of business partners, interested parties and trade fair contacts

5.1 Categories of data subjects
In the course of its business activities, PÖTTINGER GmbH processes personal data in particular from:
business partners and cooperation partners,
prospective customers,
contact persons at potential business partners,
trade fair and event contacts,
press and media representatives.
 
5.2 Purposes of data processing
Personal data is processed for the following purposes:
Establishing and maintaining business relationships,
Communication in a business environment,
Responding to enquiries and requests for information,
Organising and holding trade fairs, events and business appointments,
Presentation of public relations work, in particular by taking photos at events (a separate privacy policy is posted at events for this purpose), 
Maintaining and documentation of business contacts.
 
5.3 Legal basis for processing
The processing of personal data of business partners, interested parties and trade fair contacts is based on:
Art. 6 (1) (f) GDPR (legitimate interest), in particular in business communication, maintaining contacts and preparing and carrying out business activities, 
Art. 6 (1) (b) GDPR, insofar as processing is necessary for the initiation or execution of a contractual relationship with business partners,
Art. 6(1)(c) GDPR, insofar as processing is necessary to fulfil legal obligations.
 
5.4 Data sources (Art. 14 GDPR)
Where personal data is not collected directly from the data subject, it is obtained in particular from the following sources:
personal contacts in the business environment,
trade fairs, events and industry events (e.g. exchange of business cards),
recommendations by business partners,
publicly accessible sources (e.g. company websites, public Directories).
 
Data subjects are informed about the processing of their personal data in accordance with Art. 14 GDPR.
 
5.5 Recipients or categories of recipients
Personal data of business partners, interested parties and trade fair contacts may be transferred to the following recipients or categories of recipients, where necessary:
internal departments of PÖTTINGER GmbH,
IT and system service providers,
external service providers in connection with the organisation of events,
authorities and public bodies, insofar as there is a legal obligation to do so.
 
5.6 Storage period
Personal data of business partners, interested parties and trade fair contacts is stored for as long as is necessary for the purposes stated. In addition, data is stored in accordance with statutory retention and documentation obligations (in particular under the Austrian Commercial Code (UGB) and Federal Tax Code (BAO)) and for the assertion, exercise or defence of legal claims. Once the purposes no longer apply or the statutory retention periods have expired, the data will be deleted.
 

Newsletters and electronic direct advertising

6.1 Description of processing
The email newsletter is a free information service provided by PÖTTINGER GmbH. It is published at regular intervals (every 14 days) and briefly summarises the latest news and information from Pöttinger.
The newsletter is sent exclusively to persons who:
have actively registered for the newsletter using the contact form provided for this purpose and
have expressly consented to the processing of their personal data for the purpose of sending the newsletter.
The newsletter will not be sent without prior consent.
 
6.2 Processed data
The following personal data in particular is processed as part of the newsletter registration and dispatch process:
Email address (mandatory),
name and address (if provided voluntarily),
Time of registration.
 
6.3 Purposes of processing
Personal data is processed for the purpose of:
sending the newsletter,
providing evidence of consent given.
 
6.4 Legal basis for processing
The processing of personal data in connection with the newsletter is based on:
Art. 6 (1) (a) GDPR (consent given when registering for the newsletter).
 
6.5 Revocation of consent
The consent given can be revoked at any time with effect for the future.
The revocation can be made in particular:
via the unsubscribe link contained in each newsletter or
by sending an informal message to secure@poettinger.at
The withdrawal of consent does not affect the lawfulness of the processing carried out until the withdrawal.
 
6.6 Storage period
Personal data will be stored for the duration of the existing newsletter subscription. After revocation of consent, the data will be deleted immediately, provided that there are no legal retention obligations to the contrary.
 

Transfer to third countries

Within the scope of the processing activities described above, personal data may be transferred to so-called third countries (outside the EU/EEA) if necessary, in particular through the use of Google Analytics and Microsoft 365.
Personal data will only be transferred to third countries if there is a legal basis for this under Chapter V of the GDPR. This is particularly the case if:
there is an adequacy decision by the European Commission for the respective third country in accordance with Art. 45 GDPR, or
there are appropriate Guarantees in accordance with Art. 46 GDPR, in particular through the conclusion of standard contractual clauses of the European Union, or
one of the exceptions specified in Art. 49 GDPR applies.
 
If personal data is transferred to a third country on the basis of appropriate guarantees, we ensure that a level of protection equivalent to European data protection law is guaranteed.

Rights of data subjects

Data subjects have the following rights in relation to the processing of their personal data under the General Data Protection Regulation (GDPR):
Right of access (Art. 15 GDPR)
Data subjects have the right to request information about whether and which of their personal data is being processed. This includes, in particular, information about the purposes of processing, the categories of data processed, the recipients and the planned storage period.
Right to rectification (Art. 16 GDPR)
If personal data is inaccurate or incomplete, data subjects have the right to request its rectification or completion.
Right to erasure (Art. 17 GDPR)
Data subjects have the right to request the erasure of their personal data if the legal requirements are met, in particular if the purpose of the processing no longer applies or if consent has been revoked.
Right to restriction of processing (Art. 18 GDPR)
Under the legal requirements, data subjects have the right to request the restriction of the processing of their personal data.
Right to data portability (Art. 20 GDPR)
Data subjects have the right to receive personal data that they have provided to PÖTTINGER GmbH and that is processed automatically on the basis of consent or for the performance of a contract in a structured, commonly used and machine-readable format, or to request its transfer to another controller, provided that the legal requirements are met.
Right to object (Art. 21 GDPR)
Data subjects have the right to object at any time to the processing of their personal data on grounds relating to their particular situation, provided that this is based on Art. 6(1)(f) GDPR.
Right to withdraw consent (Art. 7(3) GDPR)
If the processing of personal data is based on consent, this consent can be withdrawn at any time with effect for the future. The withdrawal does not affect the lawfulness of the processing carried out until the withdrawal.
Right to lodge a complaint with a supervisory authority (Art. 77 GDPR)
Data subjects have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement.
