2.1 Categories of data subjects
In the course of its business activities, PÖTTINGER GmbH processes personal data in particular from:
• Customers (in particular dealers and distribution partners),
• contact persons at customers and sales partners,
• end customers, insofar as they contact PÖTTINGER GmbH in connection with service, information or satisfaction enquiries.
2.2 Purposes of data processing
Personal customer data is processed for the following purposes:
• Initiation, conclusion and processing of contractual relationships with customers and sales partners,
• Communication within the scope of business relationships,
• Technical advice, services and processing of enquiries,
• Conducting satisfaction surveys,
• quality assurance and further development of products and Services,
• Fulfilment of legal obligations.
2.3 Legal basis for processing
The processing of personal data of customers and contact persons is based on the following legal bases:
• Art. 6 (1) (b) GDPR, insofar as processing is necessary for the initiation, execution or termination of a contractual relationship with customers or sales partners,
• Art. 6 (1) (c) GDPR, insofar as processing is necessary for compliance with legal obligations,
• Art. 6 (1) (f) GDPR, insofar as processing is necessary to safeguard the legitimate interests of PÖTTINGER GmbH, in particular for customer communication ( ), conducting satisfaction surveys, quality assurance and product improvement.
2.4 Transfer of data to dealers in the frame of satisfaction surveys
If end customers expressly indicate in a satisfaction survey that they would like to be contacted by the responsible dealer, the necessary contact details will be passed on to the respective dealer.
The transfer takes place exclusively:
• at the request of the data subject and
• for the purpose of the responsible retailer contacting them.
2.5 Data sources (Art. 14 GDPR)
Personal customer data is usually collected directly from the data subject.
If personal data is not collected directly from the data subject, it comes from the following sources in particular:
• Sales partners and dealers,
• Contact details provided in the context of business relationships,
• publicly accessible sources (e.g. company websites).
2.6 Recipients or categories of recipients
Personal customer data may be transferred to the following recipients or categories of recipients, where necessary:
• internal departments of PÖTTINGER GmbH,
• Sales partners and dealers,
• IT and system service providers,
• Logistics and service partners,
• authorities and public bodies, insofar as there is a legal obligation to do so.
2.7 Storage period
Personal customer data is stored for as long as is necessary to fulfil the aforementioned purposes. In addition, data is stored in accordance with statutory retention and documentation obligations and for the assertion, exercise or defence of legal claims. Once the purposes no longer apply or the statutory retention periods have expired, the data is deleted.
